1. Acceptance of Terms

By accessing or using CrushOn AI at crushonai.com.au (the "Platform"), you confirm that you are at least 18 years of age and agree to be bound by these Terms of Use and all applicable laws. If you do not agree, please discontinue use immediately. These Terms form a binding legal agreement between you and CrushOn AI Pty Ltd.

2. Eligibility

The Platform is exclusively for adults aged 18 years and older. By creating an account, you represent and warrant that you meet this requirement in your jurisdiction. Users in some regions may be subject to additional age requirements under local law.

3. Description of Service

CrushOn AI provides an AI-powered companion chat platform where registered users may interact with AI-generated personas, create original characters, participate in a creator economy, and access adult-oriented narrative content. The Platform is for entertainment and creative purposes only.

4. User Conduct

You agree not to use the Platform to:

Generate, share, or request any content involving minors in a sexual context — this is strictly illegal and will result in immediate account termination and reporting to law enforcement
Threaten, harass, stalk, or intimidate other users or real individuals
Attempt to reverse-engineer, scrape, or exploit the Platform's AI systems
Impersonate other users, creators, or CrushOn AI staff
Violate any applicable Australian or international laws or regulations
Upload malicious code, viruses, or any content designed to disrupt the Platform

5. Intellectual Property

The CrushOn AI platform, including its design, codebase, branding, and original content, is the proprietary property of CrushOn AI Pty Ltd. Original characters created by users remain the intellectual property of their creators, subject to a non-exclusive licence granted to CrushOn AI to display and serve that content on the Platform.

6. Subscriptions and Billing

Paid subscription plans are billed in Australian Dollars (AUD) on a monthly or annual basis. You authorise us to charge your nominated payment method at the start of each billing cycle. All prices are inclusive of applicable GST. You may cancel at any time via Account Settings. Australian Consumer Law rights are not excluded by these Terms.

7. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, CrushOn AI makes no warranties regarding uptime, accuracy of AI responses, or suitability for any particular purpose. AI-generated content is fictional and should not be relied upon for any real-world decision.

8. Limitation of Liability

To the extent permitted by the Australian Consumer Law, CrushOn AI's total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to us in the three months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it at privacy.html.

10. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email to registered users. Continued use of the Platform after the effective date of any change constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute shall be subject to the exclusive jurisdiction of the courts of New South Wales, without prejudice to your rights under the Australian Consumer Law.
